These alternative dispute resolution methods mainly include :
- Negociation consisting of a calm discussion to find a quick, inexpensive and effective solution that respects the interests of all concerned.
- Mediation whose objective is to enable the parties, accompanied in their discussions by a mediator, to seek the solution that is the most satisfactory for them.
- Collaborative law : Based on rational negotiation taking account of interests and needs, the parties and the lawyers work as a team to renew dialogue, discuss the dispute and its origins, and to soothe it, in order to find a fully satisfactory substantial agreement.
- Arbitration, which consists of appointing one or several arbitrators who are asked by the protagonists to investigate the dispute, to hear the parties and to give an arbitration award.
In all cases, the final agreement can be ratified by the competent judge.
